These terms govern every order placed with Brockett Industrial Services LLC ("Brockett", "we") through this website. By placing an order you agree to them.
1. Products and part numbers
All Starke America products are sold under the manufacturer's part number (SKU) shown on the product page and on your order confirmation. Please verify capacity, lift height, voltage/phase, mounting, span and flange width before ordering; Brockett is not responsible for selections that do not match your application. Custom configurations (non-standard lifts, spans, voltages or flange widths) are quoted separately and are non-cancellable once released to the factory.
2. Pricing and discounts
Prices are in US dollars and are based on Starke America's current published list price. Our automatic dealer discount is applied in the cart and reflected on your order confirmation. Prices exclude sales tax and freight unless stated. We reserve the right to correct pricing errors before an order is released; you will be contacted and may cancel for a full refund if a price changes.
3. Order acceptance and confirmation
An order is accepted when we send an order confirmation email with your order number. Orders are then released to Starke America for fulfillment. Because most equipment is built or picked to order, an order may be cancelled without charge only before it has been released to the factory — contact us immediately at sales@brockettindustrial.com or 1 (860) 854-7853.
4. Shipping, freight and lead times
All Starke products ship directly from the Starke America warehouse at 2371 N Rainbow Dr, Warsaw, Indiana 46582. Parcel shipments (150 lb and under) are charged at the flat rates shown at checkout. Items over 150 lb ship by LTL freight: no freight is charged at checkout; we will send you the exact carrier cost with your ship date and a payment link, and the order ships once you approve it. Freight is billed at carrier cost; lift-gate, residential and inside delivery are extra. Lead times on our Shipping & Lead Times page are estimates. Equipment ships FOB origin (Warsaw, IN) — title and risk of loss pass to you when the carrier accepts the shipment. Inspect deliveries before signing; note any damage on the delivery receipt and notify service@brockettindustrial.com within 48 hours so a carrier claim can be filed.
5. Returns and cancellations
Standard, unused, uninstalled items in original packaging may be returned within 30 days of delivery with prior authorization; a restocking fee of up to 25% plus return freight to Warsaw, IN applies. Custom-configured products, cut-to-length chain, cable, track and conductor bar, and installed or used equipment are not returnable.
6. Warranty
Starke America products carry the manufacturer's 1-year (12-month) parts and labor warranty against defects in materials and workmanship under normal use and proper maintenance, as described on our Warranty & Support page. Claims must be reported within ten days of discovering a defect to service@brockettindustrial.com. The warranty does not cover damage from misuse, improper installation, lack of maintenance or acts of God. Repair or replacement is at Starke's discretion. No other warranty, express or implied, is given, and neither Brockett nor Starke is liable for consequential or incidental damages.
7. Installation and safe use
Hoists, cranes, end trucks, slings and fall protection are rated equipment that must be installed, inspected and operated in accordance with the manufacturer's manual, ASME B30, OSHA 1910.179 and applicable state codes. Purchase of equipment does not include installation unless quoted. Brockett offers professional installation, load testing and inspection services anywhere in the United States.
8. Taxes
Sales tax is charged where required. Tax-exempt customers should provide a valid resale or exemption certificate to admin@brockettindustrial.com before ordering.
9. Governing law
These terms are governed by the laws of the State of Connecticut. Any dispute will be resolved in the state or federal courts located in Connecticut.
